Since 1980s, many kinds of academic currents of institutional economics have been raising remarkably, in opposition to neoclassical theory. I will try to locate these institutional economics in power working in civil society and seize discourses of economics as governmental technology of civil society. Political economy appearing in 18th century starts to anatomize civil society. In this case, the concept of civil society taken by political economy is the same meaning of commercial society. But civil society in modern age conceives more wide meaning. It means not only commercial society but also mode of regulation among many kinds of conflicts of interests or antagonism of different classes or social groups. Moreover civil society means different types of public and social relations, corporations, associations resulting from these conflicts. So we can define civil society as intermediation between economic base and political, ideological relations. I want to stress the importance of civil society in a large sense for institutional economics. Michel Foucault, philosopher in France grasps this concept of civil society in a large sense from the point of view of modern power and governmental technology. He recognizes discourses of economics as working of modern power in civil society. The characteristics of modern power is discipline power that watches an individual and disciplines him or her as subject. Moreover modern power works upon inhabitants and population not only upon individuals. It appears oneself as the subject who produces and drives liberty. Foucault calls this power as bio-power or the power of biopolitics. I try to consider two different types of discourse of institutional economics, the regulation theory and order liberalism. And I redefine two institutional economics by the concepts of modern power developed by Foucault.
